16. What happens if a widow or widower remarries?
Family pension to a widow or widower is stopped if she or he remarries. In such a case, family pension becomes payable to other eligible family members (I.e children, parents or disabled siblings).
17. Is family pension to a childless widow also stopped, if she remarries?
No, family pension to a childless widow continues even after remarriage, if her income from other sources is less than the minimum family pension i,e. 9000 /- per month.
18. Is, family pension payable to a judicially separated spouse?
Family pension is payable to a judicially separated spouse, provided there is no child eligible for family pension. But it is not payable to a spouse judicially separated on the ground of adultery and who had been held guilty of committing adultery.
19. How is the family pension to be paid if the deceased Government servant or pensioner is survived by a widow and an eligible child from a wife who pre deceased the Government servant?
In such cases, family pension is shared equally by the surviving widow and the eligible child from the wife who pre deceased the Government servant.
20. How is the family pension to be paid if the deceased Government servant or pensioner is survived by a widow and an eligible child from a divorced wife.
In Such cases, family pension is shared equally by the surviving widow and the eligible child from the divorced wife.
