Special maternity leave for Maharashtra government employees having child through surrogacy
Female state government employees having a child through surrogacy can now avail a special 180-day maternity leave. The state government, on Wednesday, issued a resolution stating that employees will be given special maternity leave if they apply for it in advance, provide the child surrender agreement made with the surrogate mother, all medical certificates and the proof that the procedure is in accordance to the surrogacy law set by the Indian Medical Research Council.
“All papers will be verified and only then the leave will be granted. The government understands that even if it’s not a natural birth, the woman needs time to bond with the child,” said an official from Mantralaya.
This leave can be availed by the employee only once during the service and only by those who don’t already have a biological or an adopted child.
The resolution also said that the Maharashtra Public Service Act is being amended to accommodate this leave, which can also be availed by women working in aided schools, colleges and in agricultural universities.
